Memorandum on Attacks on Civil Society Organisations
We hereby present to Your Excellency this memo concerning the attack by Governmental authorities on civil society activities which are provided by the law and supported by human values and principles, as well as international Covenants and Agreements.
We, as members of the civil society organizations have in fact become a target and an easy prey for violations from a large part of the Executive sector in the form of various accusations and suspicious. Officials of the Intelligence and Security Service have regularly invaded offices of our organizations to order us to stop our planned activities, regardless of their proper organization and compliance with the laws.
Senior officials of the Humanitarian Aid Commission (HAC), which has supposedly been created to facilitate and help the functioning of civil society organizations, have regularly adopted double standard policies and actions. While they tend to appease government supporting organizations, they show obvious animosity towards independent organizations in an attitude of enmity, undermining and criminalization, which obviously greatly hampers their normal functioning.
Mr. President,
This targeting of civil society organizations has started since August, 2012, in a viscious campaign accusing them of being agents of foreign institutions and defaming their reputation, in the absence of any opportunity for them to defend themselves.
Along such lines, some of these organizations have been summoned to appear before HAC, where they are registered, for investigation and instructions for them to "comply" with the Voluntary Organisations Work Act, 2006, and other laws, as if they had not conformed to these laws before, or as if HAC had not properly performed its functions in the past.
As an example of this, HAC has in November 2012 visited the premises of these organizations, without prior notice, apparently to investigate situations of which they have had prior knowledge, in clear indication that the purposes of the visits were merely intimadatory and intended to obstruct activities.
On the other hand, the Ministry of Information and Culture has also become actively engaged in intimidating societies registered with it, either delaying the registeration formalities or making such allegations intended to close down or suspend the society. All this has recently been manifested in the recent decisions of HAC and the Ministry to close own or suspend the work of many organizations and centres in Khartoum and other States.
When such organizations and societies purported to submit complaints to the National Human Rights Commission on 30th December, 2012, security and police forces prevented the complainants from delivering their petition, in the face of protests by the Chairperson and Members of the Commission who saw no reason why the petitioners should be obstructed from entry and delivering their petition. Three of media persons were beaten and insulted and all the crowd was forcibly removed from the street, in clear violation of their constitutional rights.
Mr. President,
As the ultimate protector of the Constitution and the person responsible for the protection of all civil rights for all citizens without exception, and your responsibility for the functioning of all the Executive, including the National Intelligence and Security, the Ministry of Information and Culture and the National Commission for Human Rights, we beg to submit to Your Excellency this petition in the hope that you shall intervene for the protection of our rights, by repealing all arbitrary decisions and actions described above relating to closure and suspension of the abovementioned organizations who have been acting in full conformity with the laws, as required by the principles of justice and equality of all citizens in our beloved country. Such measures would prevent Executive authorities from unlawfully targeting citizens, or taking them on mere suspicious or intimidating them on the bases of any differences. We also aspire to lifting all unlawful restrictions on the media and pre-censorship of the press, confiscation of newspapers and targeting of journalists.
Mr. President,
In addressing this petition to Your Excellency we aspire to exercise our Constitutional rights to participate as full citizens in the broad national dialogue on the concerns of our country and its people, which is supposed to include all national sectors without exception.
As such, we look to you to take all such action as will protect the Constitution support and enhance the role of the National Commission for Human Rights which is empowered by the Constitution and the law establishing it to receive and resolve all complaints from all citizens on all human rights violations.
Looking forward to your action, please accept our highest consideration and respect.
